– Conservation groups are suing the Bureau of Land Management over a plan they say was issued while the agency’s deputy director was in charge—a move they say violates the Federal Vacancies Reform Act, Westlaw Today reports. The plan, which spelled out how 1.7 million acres of land in southwestern Colorado would be used, was approved on April 10 under Deputy Director William Pendley, who was appointed to the post by President Obama in January but was not confirmed by the Senate at the time. A lawsuit filed by the Sierra Club and other groups on Tuesday argues that because Pendley was in charge for so long, the plan should be overturned.
