Newton District Court Judge Shelley Joseph’s lawyers had argued she was protected from prosecution by judicial immunity and that the charges violated the constitutional rights of states to decline to facilitate immigration arrests, per Westlaw Today. On Monday, a federal judge refused to dismiss the indictment against Joseph, who is accused of failing to act to prevent ICE from arresting an illegal immigrant during a 2018 court proceeding. Joseph’s lawyers said she was protected from prosecution by judicial immunity and that the charges violated the constitutional rights of states to decline to facilitate immigration arrests.
